1. Purpose of the General Product Safety Regulation (GPSR)
General Product Safety Regulation (GPSR) – This policy outlines how LPX Trade SIA ensures compliance with Regulation (EU) 2023/988 on general product safety. The regulation aims to provide a high level of consumer protection and a level playing field for businesses within the European Union (EU), enhancing product safety across all distribution channels.
2. Scope
This policy applies to:
- All products offered by LPX Trade SIA within the EU, whether sold online or offline, and whether new, used, repaired, or reconditioned.
- All relevant economic operators including manufacturers, importers, and distributors associated with LPX Trade SIA.
- Excludes products explicitly exempted under Regulation (EU) 2023/988 (e.g., medicinal products, food, antiques, etc.).
3. Responsibilities of LPX Trade SIA as an Economic Operator
3.1 General Obligations
LPX Trade SIA will:
- Ensure all products placed or made available on the market are safe by design and comply with the general safety requirement.
- Conduct risk analyses and maintain technical documentation for each product.
- Provide clear labeling, warnings, and safety instructions for all products.
- Maintain traceability for each product in the supply chain for at least six years.
- Cooperate fully with national market surveillance authorities.
3.2 Manufacturer Responsibilities
If acting as a manufacturer, LPX Trade SIA will:
- Design products to ensure safety and conduct internal risk assessments.
- Provide technical documentation and safety information with each product.
- Inform authorities and consumers immediately if a product poses a risk.
- Maintain a register of complaints and corrective measures.
- Appoint an authorized representative where necessary.
3.3 Importer Responsibilities
If acting as an importer, LPX Trade SIA will:
- Verify that products comply with the regulation’s safety requirements before placing them on the market.
- Ensure products include clear safety instructions and warnings in the appropriate languages.
- Monitor products during transport and storage to prevent damage or non-compliance.
- Notify manufacturers and market surveillance authorities of any detected risks.
3.4 Distributor Responsibilities
If acting as a distributor, LPX Trade SIA will:
- Confirm that products meet safety and compliance requirements before offering them for sale.
- Take immediate action if a product is found to be unsafe, including informing manufacturers, importers, and authorities.
- Ensure clear communication of product safety information to consumers.
4. Product Safety Assessment
4.1 Criteria for Safety Assessment
LPX Trade SIA will evaluate product safety based on:
- Design, technical features, composition, and packaging.
- Product presentation, labeling, and safety instructions.
- Consumer categories (e.g., children, elderly) and use cases.
- Cybersecurity features and predictive functionalities, where applicable.
4.2 Presumption of Safety
Products conforming to European standards or voluntary certification schemes are presumed safe unless proven otherwise.
5. Information on Unsafe Products
5.1 Public Communication
- LPX Trade SIA will inform the public of any product recalls or safety risks via appropriate channels, including the Safety Gate portal.
- Consumers will be offered timely and cost-free remedies, including repair, replacement, or refunds.
5.2 Incident Reporting
- LPX Trade SIA will use the Safety Business Gateway to notify authorities of accidents or risks associated with products.
6. Internal Processes for Product Safety
6.1 Safety Procedures
LPX Trade SIA will:
- Establish and maintain internal processes to ensure product safety compliance.
- Keep detailed records of product risks, complaints, and corrective actions for at least 10 years.
6.2 Consumer Communication
- Provide clear and accessible contact points for consumer complaints and inquiries.
- Directly inform affected consumers of recalls using the mandatory recall notice template provided by the EU.
7. Compliance in Online Sales
7.1 Information Transparency
For online sales, LPX Trade SIA will:
- Display clear and accurate product descriptions, safety warnings, and manufacturer details.
- Ensure product listings comply with the regulation’s safety and traceability requirements.
7.2 Recall and Incident Management
- Directly notify consumers of recalls for products purchased online.
- Remove non-compliant product listings promptly to prevent reappearance.
8. Cooperation with Market Surveillance Authorities
LPX Trade SIA will:
- Provide product information to market surveillance authorities upon request.
- Participate in coordinated control actions (e.g., sweeps) to ensure compliance.
- Take corrective actions as directed by authorities, including withdrawing or recalling unsafe products.
9. Penalties for Non-Compliance
LPX Trade SIA acknowledges that Member States will impose penalties for infringements of the regulation. The company commits to taking all necessary steps to avoid non-compliance.
10. Implementation and Review
This policy will be reviewed annually to ensure alignment with Regulation (EU) 2023/988 and other applicable laws.
